Creator ownership certification and indemnity for uploaded content.

By uploading, publishing, or distributing any package, content, data set, skill, or digital asset (“Submitted Content”) to the Vibestreet marketplace, you certify, represent, and warrant that you are the sole and exclusive owner of all Submitted Content, or that you have obtained all necessary licences, permissions, and rights to publish, distribute, sub-license, and commercialise it on the Platform.
You warrant that the Submitted Content does not infringe upon the intellectual property rights, privacy rights, publicity rights, confidentiality rights, or contractual rights of any third party in any jurisdiction.
You accept full and sole responsibility for the accuracy of this certification. In the event of any dispute, counter-claim, or allegation regarding ownership, you shall bear all costs of defending or resolving such claims, including reasonable legal fees.
You hereby release, discharge, and absolve Vibestreet, its parent company (Altnativ Pty Ltd), its officers, directors, employees, contractors, partners, sponsors, affiliates, clients, and agents from any and all legal liability, commercial damages, and reputational damages arising from or related to your Submitted Content.
You shall indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, suits, actions, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to any allegation that your Submitted Content infringes the rights of any third party.
Nothing in this Certification limits the rights of third parties to submit takedown notices under the Digital Millennium Copyright Act (DMCA) or equivalent legislation. Vibestreet retains the right to remove any Submitted Content subject to a bona fide takedown notice.
This Certification is a continuing obligation that applies to all Submitted Content uploaded before, on, or after the date of acceptance, and remains in effect for as long as your content is hosted on or distributed through the Platform.
Acceptance is recorded when you check the ownership certification checkbox during seller onboarding. This affirmative action constitutes a legally binding electronic signature under the Electronic Transactions Act 1999 (Cth) (Australia).
